Course Outline

Though foreign governments and companies complain often about the intellectual property (IP) protection in China, none of them ignores this important commercial partner and huge market. Under these circumstances, importance is to know what and how to do for a better protection of IP in China from strategic and legal points of view. The Chinese IP law is well internationalised as is the case in most countries. However, difference always exists between countries concerning the IP protection practice because of the particular political, social and economic contexts and the legal culture or tradition on the interpretation and application of legal rules in each county. In this course, we explain how to conceive, translate, compose and register trademarks efficiently, how to apply for patent or protect the technology by trade secrets, how to benefit from copyright protection for creation, how to draft and negotiate IP license and transfer contracts, how to manage IP in case of joint venture or license, how to fight efficiently against piracy and counterfeiting with appropriate strategy and procedures. Bearing in mind comparative and international IP laws, we introduce and explain especially the special or particular regimes or aspects of the Chinese IP laws and practice and tell about pragmatic solutions to concrete IP legal problems.

Course Objectives

The objective of this course on Chinese Intellectual Property Law is, on one part, to help student to understand the Chinese IP system and the problem thereof, and, on the other, to enable foreign students to deal with IPR issues related to China. Whether they work in public or private sectors in their future career, this course will be very useful for the conception and execution of their political, diplomatic or legal strategies and actions.

Cases and materials for this course are available to students, including text of Chinese IP laws, cases and recommended articles. The course is organized with lecture of professor, discussion and homework.
